Important LPAT hearing on Monday, July 29

Article posted on July 18, 2019

SORE supporters and all residents are reminded that the Local Planning Appeal Tribunal (LPAT) will reconvene at 10 am on Monday, July 29, in the NOTL Community Centre.

To recap, Benny Marotta appealed to LPAT in 2018 for a decision on the rezoning application for ‎his convention centre/hotel proposal, rather than letting your elected Council deal with the matter.

In May of this year, LPAT granted SORE full party status in this appeal. LPAT also granted a brief adjournment to July 29 to allow for a decision in an unrelated court case that would provide guidance on the conduct of the appeal.

In the interim, the Province has passed but not yet enacted Bill 108, which significantly modifies the Planning Act in favour of developers such as Benny Marotta.

On July 29, the Town’s lawyers, supported by SORE, will be asking LPAT to set the Marotta appeal down for a hearing under the current rules, which are more favourable to the Town and to SORE. We expect Mr. Marotta’s lawyer to vigorously oppose this request.

We seek your assistance in once again packing the Community Centre that morning. Your presence was noted by the LPAT member on May 8 and it will be even more important on July 29. PLEASE PUT THIS DATE IN YOUR CALENDAR and tell your friends and contacts.

We look forward to seeing you then.
