Marotta court challenge delayed

Article posted on October 24, 2019

Regrettably, it now appears that the hearing on Benny Marotta’s court challenge to the Town’s efforts to have the Rand Estate designated under the Ontario Heritage Act will be further delayed.

We are now expecting the hearing to occur during the week of January ‎6th, 2020.

We will be looking for your attendance then to support SORE and the Town. We will advise on the exact date and time prior to then.

In the interim, the Conservation Review Board (CRB) has indicated that it intends to set a hearing date on Dec 3 for the long-delayed challenge by Mr. Marotta of the Town’s heritage by-laws before that tribunal. The Board had adjourned its proceedings pending the outcome of the court challenge subsequently launched by M‎r. Marotta, but has now indicated its intent to proceed.  Readers will recall that Mr. Marotta had initially challenged the Town’s actions before the CRB and then launched a court challenge several months later after the CRB granted SORE party status in its proceedings.

Thank you as always for your continuing support and interest.
