Tribunal schedules case management conference for Marotta Rand subdivision proposal

The Ontario Land Tribunal (OLT) has scheduled a Case Management Conference (CMC) for the Marotta Rand Subdivision proposal.

The CMC is the first step in scheduling a hearing by the OLT.

The CMC is set for FRIDAY, SEPTEMBER 9, at 10 am.

Unfortunately, the CMC will be by video conference. SORE, and we hope the Town, will be requesting that the Tribunal hold the actual hearing in person given the significant public interest in the proposal, as demonstrated by the hundreds of people who have attended previous hearings related to the Marotta Rand plans.

SORE does not know how a hearing can possibly be scheduled without:

  • a Heritage Impact Assessment given that the properties involved are all designated under the Ontario Heritage Act and have numerous important and inter-related cultural heritage attributes; and
  • a decision on the prosecution of the Marotta group for the outrageous November 2018 cutting right after the last municipal election.

We expect those points will be taken up with the Tribunal at the upcoming CMC.

The CMC is your opportunity to seek status at the subsequent hearing to present your concerns to the Tribunal. We encourage interested/concerns residents and organizations to avail themselves of the opportunity to seek status at the CMC in order to comment at the hearing on the future of arguably the most important heritage estate property in NOTL. SORE will of course be seeking party status at the hearing and we are pleased to report that the Marotta group lawyers have indicated that they will support that request.
